Party Wall Agreement - Neighbour will not sign agreement

Party wall agreement question! 
My neighbour has emailed and told me he will say no to a party wall agreement, because he is going to sell his house soon and it will affect the value.
I am getting architect and structural engineer plans at the moment, is this common?
Has anyone had similar?

Tell him that a party wall dispute would be more damaging and potentially put off any buyers.

He can't stop work, he would need to appoint a surveyor so a resolution can be agreed.

As said above he cannot stop it, it’s up to him whether it’s straight forward or if he makes it difficult.

It's a dormer loft conversion, so yes, I do need a Party Wall Agreement

You will therefore be putting in steels onto the party wall therefore need a party wall agreement

How will it affect value?? What a tool. As mentioned, disputing it will create more of a conflict, if he just agrees then it will be easier for everyone. No matter what he does he can’t stop the work, it just prolongs it which is worse for him and you.

Just get your Party Wall Surveyor to serve the appropriate notices! Then u can carry on.

I only have an architect and structural engineer so far.....was serving the notice myself...but do I need to employ the surveyor as well then?

I paid a surveyor to ensure all legally covered. 1st time buyer so didn't want to risk missing anything that could hold my builder up. Took 5 weeks in total with neighbour ignoring 1st notice served.

There is one potential problem here depending on timings. He can’t stop the party wall process and Award etc. The Award once signed is valid for a year but is only applicable to the named owners. So unless you do the works that relate to the party wall award once signed and before it is sold to a new owner you will be ok. However if it sells before you do the works you will have to start the process and pay the professional fees again!

thank you, very good point. At this rate it looks like it will be the new owners I need to agree with, and they might not be forthcoming if I discover issues in the loft walls (that's what the neighbour is telling me I have now!)

Yes it's common..people or neighbours are just selfish or jealous hence the PW Act ..it doesn't matter carry on your PW surveyor will advise accordingly

He can't stop you..that's the whole point of the PW act..but he could put off any new buyers by making it difficult...he then would by law have to declare to them to that he is in dispute with you.
